Builder’s Remedy
When a city’s Housing Element is out of compliance, the Builder’s Remedy allows developers to bypass the zoning code and city general plan for qualifying affordable housing projects. If a Builders Remedy project application was submitted prior to 1/1/2025, there are virtually no limits on the size and density of a project proposed. Subsequent to 1/1/2025, in exchange for more certainty in the entitlement process, AB 1893 limits the density for Builders Remedy projects.

Public hearing on Draft Housing Element. Reviewed 250 survey responses. Survey is still open until June 4. Planners commented on saving at risk units, partnering with agencies for affordable housing, consider condo coversions to affordable housing. Public comments on the need for mixed transit and need to include more days for public engagement. Asked for address when giving public comment.

No formal decisions were established at this meeting. Laguna Niguel is required to provide zoning for 1,207 affordable housing units. Those who wish to complete the housing survey must do so by May 7th 2021. All planning commissioners spoke in support of affordable housing as did the public participants who commented. One public commentator who is also a realtor, urged the council to consider utilizing land near the Ziggurat building to make room for affordable housing.
