Builder’s Remedy
When a city’s Housing Element is out of compliance, the Builder’s Remedy allows developers to bypass the zoning code and city general plan for qualifying affordable housing projects. If a Builders Remedy project application was submitted prior to 1/1/2025, there are virtually no limits on the size and density of a project proposed. Subsequent to 1/1/2025, in exchange for more certainty in the entitlement process, AB 1893 limits the density for Builders Remedy projects.

Laguna Beach City Council/ Planning Commission Meeting 4/6/2021

City staff member, So Kim gave a presentation which highlighted specific building sites which can fulfill Laguna Beach’s 2021-2029 RHNA assessment. Affordable housing needs have increased dramatically since the last RHNA cycle. Laguna Beach is required to plan for 394 affordable housing units. Potential building sites include portions of church, and Mission Hospital property. Members of the planning commission discussed ways to incentivize developers to create affordable housing by expediting development process. The need for third -party funding and incentives to develop was emphasized. There is interest in creating housing developments in commercial areas of downtown. At least one member of the planning commission has great interest in developing artist live/ work units
