Builder’s Remedy
When a city’s Housing Element is out of compliance, the Builder’s Remedy allows developers to bypass the zoning code and city general plan for qualifying affordable housing projects. If a Builders Remedy project application was submitted prior to 1/1/2025, there are virtually no limits on the size and density of a project proposed. Subsequent to 1/1/2025, in exchange for more certainty in the entitlement process, AB 1893 limits the density for Builders Remedy projects.

Hayward Housing Element:

2100 units in pipeline that they expect will ALL be developed

2409 units remaining

Claiming 1233 surplus with existing zoning, 3600 units total, therefore no rezoning required

Mostly due to Route 238, Mission Boulevard, and Downtown Specific Plan area (edited) 

2483 units on Underutilized, 1200 units on vacant

320 ADUs, more than half of which are lower income

Consultant says HCD wants a 5-10% buffer (wrong)

Ironically staff says there are 10 projects approved prior to 2018 that they are counting as pipeline but haven't been built... but that they're counting on them all to develop

They are counting the BART parking property

As well as some of the city parking lots
