Builder’s Remedy
When a city’s Housing Element is out of compliance, the Builder’s Remedy allows developers to bypass the zoning code and city general plan for qualifying affordable housing projects. If a Builders Remedy project application was submitted prior to 1/1/2025, there are virtually no limits on the size and density of a project proposed. Subsequent to 1/1/2025, in exchange for more certainty in the entitlement process, AB 1893 limits the density for Builders Remedy projects.

City deadline to complete the rezonings identified in the Housing Element is February 12, 2025, in accordance with SB 197.
The 6th Cycle Housing Element was found in compliance by HCD on June 21, 2022, and within a year of the statutory deadline of October 15, 2021. Therefore, under SB 197, they were granted 3 years and 120 days to complete the required rezonings.
The Housing Element identifies three sites for rezoning. The largest of the three sites, which allows up to 2,500 housings units (our RHNA was 3,028) was rezoned within a month of Housing Element certification. Staff is working to rezone the two remaining sites in the coming months and expects to complete them prior to the February deadline.
